basis of innovative economy is a set of factors, the most important of which appear to intellectual activity, initiative, entrepreneurship as a factor of production.World practice has proved that free enterprise as a factor of production and the products of intellectual activity today are the most important asset of any business entity.

dominant position in world trade take intellectual orientation of firms and corporations, providing creation of modern technologies and their legal protection in promising markets.The struggle for exclusive (patent) rights to new technologies, new business methods, computer operating systems and software products and other innovative solutions.Information as a factor of production itself has become the most valuable commodity, possession of which is the key to economic success.The innovation economy factors of production is an innovative enterprise, as well as the possession of intellectual property.

Creating a strategic competitive advantage provided by the capacity of intangible assets in the organizations (patents and industrial designs, certificates of trademarks, etc.), formation of a portfolio of patents in order to maximize the consolidation of exclusive rights to the disposal of intellectual property created.Obtaining exclusive rights to intellectual property products allows the owner to sell successfully in the markets of goods and services, to prevent copying of their competitors to gain additional revenues from the sale of licenses.And entrepreneurship, as a factor of production or management of particular area where all the said activity is even more prominent position.The reason for this is that the innovative way of a number of countries has led to the formation of a new sector of world trade - intellectual property market.The fastest growing section of the sector stands trade licenses to new technologies, software engineering, and technical consulting services, including services for the exchange and transfer of intellectual property products.

annual growth rate of these services account for about 10%.The trade patented technologies include a growing number of countries.This company in South Korea, China, Singapore, Brazil, India and other countries.Developing Russian market of intellectual property.But at the same time, if global corporations and companies are on the path of increasing the share of intellectual capital and focus on the establishment of legal protection and commercialization of intellectual property products, the majority of domestic commercial and scientific organizations still show relatively low and patent-license activity, inefficientdispose of the exclusive rights by the OIC.Of registered 01.01.2011 patents it acted only 33% of patents annually in practical use only about 10% of inventions created (for other objects even lower), only about 5% of the goods and services have a legal protection in the countries of export,less than 1% of inventions patented by the procedure of the international registration.In 2010, of all the license agreements, it was, containing the patented invention, 19 (4%), utility models 22 (4.7%), industrial designs 6 (1.3%), know-how, 79 (16.9%), trademarks 331 (70.7%).About 80% of license agreements concluded between the residents of the country, which suggests that developing a domestic market the licensed trade and entrepreneurship, as a factor of production, the development in this segment is not sufficient.

Problems of legal protection for new technology products for export, the commercialization of the OIC foreign patenting and sale of licenses for domestic achievements related to the lack of funding for research and development, the reduction of volumes and financing firm and industrial science, the lack of resources to obtain legalprotection in foreign countries, rawness of market mechanisms to encourage authors and entities create the OIC, the lack of modern infrastructure of intellectual and commercial activity.

To solve these problems, you should:

- provide priority funding for high-tech projects, ascribed to the strategically important for increasing exports, the list of which it is advisable to determine the special decree of the government;

- to reduce the income tax rate for the innovatively active organizations of up to 10%, free small and medium business entities from payment of income tax;

- abolish the taxation of intangible assets of the entities in the statement on the accounting records of the OIC;

- to stimulate the creation and development of innovation infrastructure, including industrial parks, business incubators, venture capital companies, small innovative organizations through the donation of their land and assets of state-owned enterprises, scientific and educational institutions;

It seems appropriate to develop:

a) technological schemes (models) the commercialization of innovations comprising of the OIC in the field of high technologies as practical advice for economic entities.

b) teaching materials for the sale and purchase of licenses for high-tech development, containing patented technical and artistic and design solutions.

c) guidelines for the wider use of modern brand technologies to enhance the competitiveness of goods and the value of enterprises.
